Terms
& Conditions of Hire relating to the Nu Soundz 'Hire Agreement'
Clause 1
Nu Soundz Entertainments offers you two methods of payment, you choose
whichever is most convenient to you: A)You are charged a minimum basic
rate. Any monies on stage in the form of gratuities remain with Nu Soundz
Entertainments; or B) You can decide to pay an overall charge. In this
method you keep any money on stage in the form of gratuities. N.B. Whichever
method you choose, the minimum deposit stated is required to confirm the
booking. The remaining balance must be paid and cleared by the day of
the event before the show starts. (see also Clauses 4 and 10). A one hundred
pound surcharge will apply and will be paid by the hirer if the event
is an all day affair held at the same venue where Nu Soundz Entertainments
is required to perform in the same location immediately or shortly after
the ceremony. For evening performances a further one hundred pound surcharge
is payable by the hirer if the finishing time is agreed or extended beyond
midnight.

Clause 2
The hirer may forgo his/her commitment to this agreement provided
that 28 days' notice is given in writing to Nu Soundz Entertainments.
All communication should be addressed to Nu Soundz Entertainments, PO
Box 443, Wolverhampton WV2 3YF. In this or any other eventuality the deposit
is non-refundable. If the booking is cancelled within 28 days of the contracted
event date the hirer will pay the full balance. This agreement may be
terminated by Nu Soundz Entertainments if the hirer breaches any of the
Terms & Conditions.

Clause 3
Nu Soundz Entertainments will not play any more or longer than the
contracted times (which should be for a duration not longer than five
hours between the start and finish times) unless this is agreed and convenient
to Nu Soundz Entertainments at that time and place. If such an arrangement
is made then it will also be subject to the Terms & Conditions contained
here-in and be charged at one hundred pounds per hour or part hour if
less than one.

Clause
4
Safe and easily accessible loading areas must be made available for
Nu Soundz Entertainments and it's equipment and personnel. Penalties will
be charged by Nu Soundz Entertainments payable by the hirer if access
to the venue and stage or performance area is hindered by any obstruction
or stairs. The charge will be one hundred pounds per obstruction or up
to two flights of stairs. A flight of stairs will be deemed to be five
or more steps in unbroken succession. The hirer must ensure that the stage
or performance area is on the same storey and adjacent to the dance-floor.
If the stage or performance area is split from the dance-floor whatsoever
then a further one hundred pounds surcharge will be paid by the hirer
(unless he/she has opted for payment method B).

Clause
5
The hirer is solely responsible for any costs arising from any act,
omission, neglect, injury, damage or loss caused by him/herself or any
of his/her family, guests, attendees or service-providers to Nu Soundz
Entertainments or any person, persons or equipment their-of.

Clause 6
Nu Soundz Entertainments shall not be liable for any breach of these
Terms & Conditions or failure to perform any obligation as a result of
Acts of God, government control, restrictions or prohibitions or any other
act or omission similar or dissimilar caused beyond the control of Nu
Soundz Entertainments. Whilst Nu Soundz Entertainments makes every effort
to ensure all the contracted effects are used during it's performance
it shall not be held responsible for limiting factors beyond it's control
such as those stated above or for the availability of suitably qualified
personnel e.g. drummers. A monetary concession may be made to address
this eventuality.

Clause
7
Nu Soundz Entertainments does not accept proof of postage of any
agreement, instruction or amendment as proof of delivery. This application
is acceptable only if fully completed and returned with the required deposit
to Nu Soundz Entertainments within fourteen days of the 'Date of Issue'.
Nu Soundz Entertainments reserves the right to reject any application
without obligation or requirement to give any reason or justification.

Clause 8
Nu Soundz Entertainments reserves the right to change or vary the
Terms & Conditions of this agreement as a result of any new legislation,
statutory instrument, government or in-house regulations or licences and
to make amendments to the standard Terms & Conditions of the said agreement.
Such amendments or variations shall be limited to the extent necessary
for these purposes.
Clause 9
A Roadshow consisting of a mobile discotheque under the instruction
of Nu Soundz Entertainments will be present to perform on the date agreed
with the hirer for the duration of the times agreed. A crew of approximately
five persons will accompany the Roadshow.

Clause 10
During the performance the stage or performance area shall be occupied
and controlled by Nu Soundz Entertainments and it's related road-crew.
The hirer must notify Nu Soundz Entertainments in writing of any other
musical act, acts or dance troupes performing on the same day. Nu Soundz
Entertainments will charge the hirer for the use of it's equipment by
the other act or acts. In this eventuality a one hundred pounds surcharge
will be paid by the hirer (unless he/she has opted for payment method
B).

Clause
11
A safe stage or performance area of no less than ten metres from
left to right and four metres from front to back is required for Nu Soundz
Entertainments. Three double power points on a 30-amp mains ring are required
on stage for use by Nu Soundz Entertainments only.

Clause 12
Clean and private changing facilities must be available for Nu Soundz
Entertainments. A break for refreshment lasting for approximately fifteen
minutes will be taken by Nu Soundz Entertainments at a convenient time
during the performance. The hirer is responsible for ensuring that food
and soft-drinks/drinking water is supplied to the road-crew.

The venue must be suitably licensed for such performances.

Clause
14
Nu Soundz Entertainments will accommodate reasonable changes in schedule
and will endeavour to co-operate with the hirer to make the event or occasion
a success. Such changes will incur additional charges and must be communicated
in writing at least fourteen days prior to the event date. If the hirer
fails to notify or disclose any information or factor required on the
application that would bear relevance to the performance of Nu Soundz
Entertainments or the preparation for it or would effect the price charged
for it's services, the hirer is responsible for costs or pricing errors
arising from such omissions and will be charged accordingly. These and
any additional costs will be paid by the hirer. However, if the extent
of the hirer's failure to notify Nu Soundz Entertainments of such circumstances
is such that the senior officer for Nu Soundz Entertainments at that time
and place deems the situation to be dangerous or detrimental to Nu Soundz
Entertainments or its personnel or equipment eg in terms of Health & Safety,
Security etc, Nu Soundz Entertainments reserves the right not to perform
under such circumstances at no financial loss to itself. Hence the hirer
agrees to pay the full contracted booking charge.

Clause 15
If the name and full postal address details for a venue on the application
are incorrect or omitted, and when subsequently the correct details are
communicated to Nu Soundz Entertainments the venue is deemed to be unsuitable
for the purposes of Nu Soundz Entertainments, the booking will be immediately
cancelled and the hirer will be notified in writing of the cancellation.
The standard cancellation terms of Clause 2 will apply.

Clause
16
The hirer is responsible for ensuring that Nu Soundz Entertainments
have full and appropriate access to the venue and performance area at
least two hours prior to and after the agreed start and finishing times
respectively. The hirer is further responsible for ensuring restrictions
arising from Fire and Health & Safety regulations in force at the particular
venue are communicated to Nu Soundz Entertainments for the purposes of
the detonation of theatrical pyrotechnics.

Clause
17
If entrance to the event for which Nu Soundz Entertainments is hired
to perform is generally by means of the purchase of a ticket and/or the
payment of entrance fees a two hundred pounds surcharge will be paid by
the hirer (unless he/she has opted for payment method B). The hirer must
further ensure that at least two suitably qualified security officers
are supplied and dedicated to the control of the stage or performance
area (see also clause 5). If the hirer is unable to guarantee to supply
his/her own security staff then a surcharge of one hundred and fifty pounds
will be paid to Nu Soundz Entertainments by the hirer.

Clause
18
The failure of the hirer to act in accordance with the Terms & Conditions
of this agreement either whole or in part will be communicated to and
registered and recorded by such regulatory associations as MASTERS, Elite
Occasions and/or credit reference agencies prior to taking the appropriate
legal action.
